These Terms & Conditions (“Terms”) govern your use of the website www.psglobalmarketing.com (“we”, “us”, “our”, “the Agency”), as well as any services purchased through the Site. By accessing or using our Site or purchasing services, you (“Client”, “User”) agree to be legally bound by these Terms.
If you do not agree, please discontinue use of the Site.
1. Description of Services
We provide digital marketing and related services, including but not limited to:
• Paid advertising management (Meta, Google, TikTok, etc.)
• Social media strategy and content creation
• SEO optimization
• Website and landing page development
• Funnel building & conversion optimization
• Email marketing and automation
• Branding and creative services
• Marketing consultancy
A detailed scope of work, pricing, and deliverables will be provided in a proposal, agreement, or invoice before payment.
2. Eligibility
By using the Site or purchasing services, you confirm that:
• You are at least 18 years old.
• You have the legal capacity to enter into a binding agreement.
• You will use our services in compliance with all applicable laws and platform policies.
• Your business does not belong to prohibited categories such as illegal goods, counterfeit items, unlicensed gambling, adult content, financial scams, pyramid schemes, or any activity restricted by payment processors.
We reserve the right to refuse service to any business that violates legal, ethical, or payment processor standards.
3. Payments & Billing
• All payments must be made in full before services begin unless otherwise agreed in writing.
• We accept payments via approved payment processors, bank transfer, credit/debit cards, or other provided methods.
• All fees are clearly stated before checkout or in the issued invoice.
• Advertising budgets are not included in service fees and are always paid separately and directly by the Client.
All payments are final and non-refundable, except as outlined in Section 4.
If a payment fails or is disputed, service delivery may be paused until the issue is resolved.
4. Refund & Cancellation Policy
4.1 Refunds
Refunds are only issued in the following situations:
• Accidental duplicate payment
• Billing error on our side
• Service was paid for but not initiated within 15 business days
• A legally required refund under applicable consumer protection laws
Refunds are not issued for:
• Completed services or work already started
• Delays caused by incomplete Client information or missing access
• Advertising performance (ROAS, sales, conversions, CPC, CPM, etc.)
• Account bans, disapprovals, or platform restrictions
• Subjective dissatisfaction when services were delivered as described
• Misuse or violation of platform or industry policies by the Client
4.2 Cancellations
• A Client may cancel before work has started.
• Once a service has begun, the full payment becomes non-refundable.
• If a project is inactive for 30+ days due to Client inactivity, we may close it without refund.
5. Client Responsibilities
The Client agrees to:
• Provide accurate business information
• Provide timely access to accounts, materials, and approvals
• Ensure compliance with advertising policies (Meta, Google, etc.)
• Ensure the legality and accuracy of any product, claim, or promotion advertised
• Avoid requesting any service involving prohibited activities
We may suspend or terminate services if the Client violates legal or platform policies.
6. No Guarantee of Results
Digital marketing performance depends on many factors outside our control.
Therefore, we do NOT guarantee:
• Specific sales, conversions, or revenue
• Any ROAS or performance metrics
• Approval of ads by advertising platforms
• Stability of advertising accounts
• Traffic volume or results from campaigns
We provide professional services but cannot guarantee outcomes.
7. Third-Party Platforms & Tools
Our services may rely on external platforms such as Meta, Google, TikTok, Shopify, Wix, analytics tools, and others.
We are not responsible for:
• Policy changes
• Algorithm updates
• Technical issues
• Account bans
• Data inaccuracies from third-party tools
• Downtime or service suspension by third-party providers
The Client is responsible for complying with the terms of these platforms.
8. Intellectual Property
• All creative assets, content, copy, strategy documents, and materials produced by us remain our property until full payment is received.
• After payment, the Client receives a non-exclusive license for business use.
• We may include anonymized examples of work in our portfolio unless the Client requests otherwise in writing.
9. Limitation of Liability
To the fullest extent permitted by law, we are not liable for:
• Loss of profits, revenue, or business opportunities
• Advertising account bans or disapprovals
• Errors or delays caused by third-party platforms
• Indirect, incidental, or consequential damages
• Data loss or business interruption
Our maximum liability is limited to the amount the Client paid for services during the last 30 days.
10. Privacy & Data Protection
We collect only the information necessary to deliver our services.
Personal data is processed in accordance with GDPR and our Privacy Policy, which forms part of these Terms.
We do not sell or share Client data with unauthorized parties.
11. Termination
We may terminate the agreement immediately if:
• The Client violates advertising or payment processor policies
• The Client misrepresents information or engages in illegal activity
• Payment is reversed, charged back, or disputed without valid reason
All unpaid invoices remain due upon termination.
12. Governing Law
These Terms are governed by the laws of Bulgaria
Any disputes will be resolved in the competent courts of Bulgaria.
